Except as otherwise provided in these Terms of Use, the Content may not be copied, downloaded, or stored in a retrieval system for any purpose, nor may it be redistributed, reused, resold, or modified for any purpose, without the express written permission of ANB Bank. You agree not to:

1. collect information from the Site or the Services using an automated software tool or manually on a mass basis;
2. use automated means to access the Site or the Services, or gain unauthorized access to the Site or the Services or to any account or computer system connected to the Site or the Services;
3. obtain, or attempt to obtain, access to areas of the Site or our systems that are not intended for access by you;
4. “flood” the Services with requests or otherwise overburden, disrupt, or harm the Site, the Services or our systems;
5. restrict or inhibit other users from accessing or using the Site or the Services;

The trademarks, service marks, and logos displayed on the Site are registered and unregistered marks of ANB Bank and its licensors. You acknowledge and agree that, as between you and ANB Bank, ANB Bank is and will remain the sole owner of the Site, the Services and the Content, including, without limitation, all patents, copyrights, trademarks, trade secrets, and other intellectual property and proprietary rights therein and thereto.

Account Registration

Access to and use of certain Services may require you to register for an account. You are responsible and liable for all activities conducted through your account using your login credentials, regardless of who conducts those activities. You agree to immediately notify ANB Bank of any unauthorized use of your account, or any other breach of security. We are not liable for any loss or damage arising from your failure to protect your username or password.

Security

Emails you send to us are NOT secure; therefore, you should not include any personal information in your emails. ANB Bank will never ask for your password, Social Security Number or other personal information in an email.

Errors and Delays

We are not responsible for any errors or delays in responding to an email or any form caused by an incorrect email address provided by you or other technical problems beyond our control.

Disclaimers and Limitations

The Site and the Services are provided by ANB Bank on an "As Is" basis. ANB makes no representations or warranties of any kind, express or implied, regarding the operation of the Site or the Services, or the information, content, material or services included on the Site. To the fullest extent permissible by applicable law, ANB disclaims all warranties, express or implied, including but not limited to, implied warranties of merchantability and fitness for a particular purpose. By using the Site, you agree ANB will not be liable for any damages of any kind arising from the use of the Site, including but not limited to direct, indirect, incidental, punitive and consequential damages. Additionally, financial calculators are provided on the Site for your convenience. The information obtained from the use of these calculators are strictly estimates and may not be representative of actual payment amounts. The accuracy of the results is not guaranteed.

Change and Suspension

ANB Bank reserves the right to make changes to, suspend, or discontinue (temporarily or permanently) the Site, the Services or any portion thereof (including any Content) at any time. You agree that ANB Bank will not be liable to you or to any third party for any such change, suspension, or discontinuance.

Suspension/Termination of Access

ANB Bank has the right, in its sole discretion, to deny access to, and to suspend or terminate your access to, the Site or the Services or to any features or portions thereof, at any time and for any reason.  If we suspend or terminate your access to the Site or the Services, you will continue to be bound by the Terms of Use that were in effect as of the date of your suspension or termination.

Governing Law; Jurisdiction and Venue

These Terms of Use and any dispute or claim arising out of or related to these Terms of Use will be governed by and construed in accordance with the laws of the State of Colorado, other than such laws and case law that would result in the application of the laws of a jurisdiction other than the State of Colorado.  You and ANB Bank agree to the exclusive jurisdiction of the state and federal courts located in Denver, Colorado for the resolution of any dispute or claim arising out of or related to these Terms of Use.

Entire Agreement

These Terms of Use, including our Digital Privacy Disclosure and Privacy Notice, constitute the sole and entire agreement between you and ANB Bank with respect to the Site and the Services, and supersede and replace all prior or contemporaneous understandings or agreements, written or oral, regarding such subject matter.

General

If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect. All rights not expressly granted herein are reserved. No delay, waiver, forbearance, or omission by ANB Bank to exercise any power or rights arising out of this Agreement shall affect or impair its rights or constitute a waiver of any right hereunder.
